JwJ Takes Action to Defend Workers' Rights from KY River Decision
There are three cases currently pending at the Bush appointed National Labor Relations Board (NLRB) that together are often referred to as the "Kentucky River" decisions because they will serve to clarify issues left open by the Supreme Court's Kentucky River decision in 2001. Generally, the decisions will affect the way the term "supervisor" is interpreted by the Board. A broad interpretation of who is a "supervisor" could allow employers to strip up to 8 million more workers from their right to belong to a union. The impact is likely to be particularly dramatic in the health care industry, in construction, and in other skilled occupations where it is common for higher skilled workers to direct the work of lower skilled employees.
From July 10 to July 20 in more than 20 cities, workers turned out by the thousands to demand that the National Labor Relations Board (NLRB) protect their right to join a union. Workers from dozens of industries stood together to speak against pending Labor Board decisions. The Week of Action, organized by the AFL-CIO, included marches, rallies, and large-scale demonstrations at Labor Board offices and healthcare facilities. Jobs with Justice helped mobilize for rallies in cities across the country including Boston, Chicago, Buffalo, Eugene, and Seattle.
In Nashville, Central Tennessee JwJ organized a 200-person march and rally from the State Legislature to the NLRB. JwJ worked with the AFL-CIO State Fed, the CLC, The Teamsters, SEIU, Interfaith Worker Justice, and others to plan and mobilize for the rally. In Washington, DC, 1,500 workers participated in a large-scale march to shut down the National Labor Board offices. In an act of nonviolent civil disobedience, union activists, religious leaders, and community members linked arms and blocked traffic during lunch rush hour.
JwJ Coalitions are continuing to keep the pressure on to demand that workers' rights stay protected. Chicago Jobs with Justice organized a 300 person rally outside the Region 13 office of the NLRB on July 13. On August 8th, Chicago JwJ joined nurses from across the country to protest outside the American Hospital Association's offices in Chicago, promising to fight for the right to organize and patients' rights.
In Portland, JwJ joined a Governor Kulongoski and members of Congress at a 250 person rally at the regional NLRB office during the July week of action. On August 9th, more than 150 people participated in another spirited action at the NLRB. Participating were faith leaders, community leaders, and members of more than 20 unions, including AFT Healthcare NW, SEIU (49 and 503), Carpenters, Teamsters, and more. The action featured a skit starring "President George Bush", who was there to introduce "his boys" on the NLRB. After they were introduced, and loudly booed by the crowd, the NLRB members divided the crowd, calling every third worker a boss. These "bosses" were then seperated from the rest of the workers and stripped of their pensions, health care, job security, and other things that they had won through their unions. After this dramatic interpretation of the meaning of the Kentucky River decsison, members of a delegation to meet with the local NLRB office reported on their conversation. During their visit,, the head of the Portland office, Cathy Callahan, agreed to forward protestors concerns to Washington, D.C.

Ohio JwJ Coalitions Fight for a Minimum Wage Increase
Jobs with Justice coalitions throughout Ohio were part of a successful state-wide campaign to put a referendum on November's ballot on whether to raise Ohio's minimum wage to $6.85/hour. In Toledo, Let Justice Roll, Toledo Area Ministries and Toledo Jobs with Justice spearheaded the effort throughout the faith community to place the issue on the November Ballot. In June, Toledo JwJ held a successful press conference and rally with members of the faith community. More than 15 faith leaders came together for the event, which was attended by several print and television stations. Cleveland Jobs with Justice also played an integral role in developing a faith based initiative to raise Ohio's minimum wage. Working in conjunction with Let Justice Roll, Cleveland JwJ collected more than 5,000 valid signatures for the November ballot initiative. In addition to the thousands of signatures collected, JwJ also built new and strong connections with allies in the Cleveland faith community while also branching out into Summit and Lorain county to do work with partners in those key areas. The combined efforts of Cleveland JwJ and Let Justice Roll helped to put more than one county over the top in signatures. Vicki Meath, Cleveland JwJ's organizer on the minimum wage campaign, has done outstanding work and we appreciate her committment to this issue.

Northeast JwJ Coalitions are Building a Base of Educated Voters
Four JwJ coalitions in the Northeast are building power this Summer and Fall through non-partisan voter outreach, education, and mobilization. In Rhode Island, JwJ has partnered with community organizations DARE (Direct Action for Rights and Equality) and the Olneyville Neighborhood Association with the goal of talking to over 3,000 voters about issues like health care, immigrant rights, and community-based economic development. The three groups will then work together to turn voters out to the polls and engage them in future campaigns.
In Vermont, the VT Workers' Center/JwJ is coordinating a statewide canvass for Universal Health Care. Activists will talk to voters in five cities, asking them to sign petitions to support health care reform. The goal is to build a grassroots base on the issue who fight for true universal health care in the next legislative session.
In New York City, JwJ is coordinating NY VOTE for the second year. NY VOTE is an alliance of NYC organizations that is giving community residents the skills and materials to go door-to-door in their neighborhoods, educating voters about progressive issues, and turning these voters out to the polls. In the first year of the program, NY VOTE identified more than 5,000 voters who supported progressive values and reminded them to vote on Election Day. NY VOTE aims to do more than mobilize voters at election time - it also seeks to build organizations with roots in the community that know how to organize voters at election time and how to engage them in meaningful policy and organizing campaigns between elections. This year NY VOTE will expand its voting base to 10,000 voters.
Buffalo CEJ/JwJ and Rochester Metro Justice (a JwJ solidarity contact) are also participating in a developing state alliance connected with the Pushback Network. CEJ and Metro Justice will be working in a coordinated effort with NYC and will begin building their own local voter education and mobilization programs similar to NY VOTE. In Buffalo, CEJ/JwJ will work with CBTU, NY Citizen Action, and People United for Sustainable Housing to talk to 1,000 voters and turn them out to vote.
Nationwide Hotel Workers Victory
The Hotel Workers Rising Campaign won an important victory this July in an agreement with the Hilton Hotels Corporation. UNITE HERE was able to secure a new contract relating to the Hilton New York and Waldorf-Astoria Hotels, and announced a five-year agreement that the parties have termed a "Partnership for Future Growth." Important elements of the agreement include the following:
- Hilton and UNITE HERE have agreed to work together on growth where it makes strategic and economic sense, including card check agreements where appropriate.
- Hilton and UNITE HERE will work together toward labor peace in other cities with collective bargaining this year and for the five-year period of the agreement, including Hilton receiving preferred status as a hotel management company of choice for the union.
- A structure that binds the two parties to explore ways to enhance Hilton Hotels' productivity and competitiveness, especially in the area of food service and restaurants.
Jobs with Justice coalitions throughout the country have been mobilizing as part of the Hotel Workers Rising Campaign for the last several months. In May, coalitions in Eastern Massachusetts, Washington State, Chicago, and Atlanta participated in the week of leafleting actions at Hilton hotels organized by Change to Win. To support the key bargaining fights in Chicago and Boston, JwJ coalitions in those cities have been assisting with mobilization and relationship building with key community allies.
Living Wage Victory in Louisville, KY
For the last 19 months, Kentucky Jobs with Justice has led the Louisville Living Wage Coalition in an effort to strengthen the Living Wage Ordinance that was approved in 2002 and then demolished in 2003. The coalition-which included active involvement from a host of organizations including AFSCME, Fairness Campaign, Kentuckians for the Commonwealth, Metropolitan Housing Coalition, and Sisters of Charity of Nazareth-decided to pursue a budget appropriation of $11.48 per hour as a living wage for all full-time local government workers.
In Louisville, JwJ's activities included bringing in national ACORN to facilitate a state-wide workshop on Living Wage, sending all 26 Metro Council members a living wage questionnaire to gauge where they stand on the issue, organizing diverse teams to meet with all 26 of the Metro Council members, generating more than 1,000 letters to the Mayor and Metro Council, and speaking about the issue on the local NPR affiliate. In May 2006, JwJ held a wage rally featuring local elected officials, president of the Kentucky AFL-CIO, and youth spoken word artists.
JwJ made the living wage an issue for the Louisville Metro Council and has been an ally to the Lexington, KY Living Wage Campaign, building a state-wide movement for a living wage. That state-wide work resulted in JwJ being viewed as a resource for information on wage issues when Kentucky Educational Television, the state PBS affiliate, decided to host a panel discussion on minimum wage. In July 2006, Kentucky JwJ was contacted by Congressman Charlie Miller of California when the Democratic Caucus decided to host a forum on the minimum wage in Louisville.
In a turn that local media has dubbed "progressive," Louisville's mayor presented his budget to the city for FY07 that included a living wage of $11.00 per hour for all full-time, non-union workers. In response, the Louisville Metro Council approved a budget appropriation covering all full-time, non-union workers with a living wage of $11.50 per hour because the coalition never gave up, even after the Mayor presented his proposal.
Chicago Passes Big Box Living Wage Ordinance
On July 26th, the Chicago City Council passed the Big Box Living Wage ordinance by a large margin, 35-14. Over 2 years of collaboration and grassroots efforts by labor, community, and religious groups clearly showed aldermen that their constituents wanted mega-retailers to treat their employees justly. Mayor Daley is poised to veto the ordinance, and big retailers are threatening to pull out of Chicago in hopes of swaying enough Aldermen to break their veto-proof majority. Chicago JwJ is continuing to keep the pressure on until the measure is solid!
Did you hear us roar? From June 1-4, twenty remarkable women from JwJ coalitions around the country came together for the 3rd JwJ Women's Retreat. Thirteen staff and seven volunteer leaders participated in three days of discussion, reflection, and problem-solving. The goals of the retreat were to strengthen relationships among women in the JwJ network; to create a space within JwJ for women to talk about their unique experiences doing this work and challenges they face in the work; to increase skills of women organizers in the JwJ network; to identify tools to build support systems and sustain ourselves as organizers; and to build a more powerful Jobs with Justice network.
Philly JwJ, SLAP, and USAS take on Verizon Wireless!
On August 11, 2006 students and workers came together to demand that Verizon "break down the wall!". More than 130 student's from United Students Against Sweatshops, Philly SLAP, as well as members of CWA local 13000 and Local 13500 held a picket and rally at a Verizon Wireless store. Speakers from Philly JwJ, CWA, and the AFL-CIO delivered a powerful message to VZW and demanded that they recognize the right of workers to organize. Members of USAS, who were in town at a conference, led the coalition of fired-up activists on a march to a Verizon Business location. Rank and file leaders and student activists took over the streets, marching and chanting "Ring, Ring? Hello! Union Busting's got to go!" Eugene Pepsi Workers Win New Contract
Eugene Springfield Solidarity Network/JwJ (ESSN) helped Pepsi-Cola workers, members of Teamsters Local 206, in Eugene, OR to win a solid victory. The workers are truck drivers, warehouse workers, and maintenance workers Pepsi distribution center. Twice the workers voted down an unacceptable agreement, and voted to authorize a strike. Negotiations seemed stalled, and management advertised for scabs. But the Teamsters, with support from ESSN and IBEW members fresh from an ESSN-supported strike victory of their own, weren't about to let the work go to scabs. They went to the site where management was interviewing people to take the jobs of the Teamsters in the event of a strike. More than half of the potential applicants decided not to apply after all, and management was only able to recruit about a dozen scabs. A few days later management, having gotten the message, returned to the bargaining table and the workers won an acceptable agreement.
WA State JwJ Mobilizes for VA Benefits
As part of the current attack on veterans' benefits, a Bush-appointed commission held a hearing in Tacoma, WA on veterans' disability benefits. VA workers and other members of the American Federation of Government Employees (AFGE) partnered with JwJ to picket the hearing. More than 200 vets and supporters jammed the hearing, while a smaller group of AFGE and JwJ activists remained outside to stress that "today's troops are tomorrow's vets," and demand that the war not be paid by sacrificing veterans' benefits. The message got through. Responding to the AFGE/JwJ message, the hearing began with a statement from the commission that they would not balance VA benefits on the backs of veterans. The action got prominent coverage in both the online "VA Watchdog" and the Ft. Lewis Ranger, the newspaper serving the large army base near Tacoma.
South Florida JwJ Holds Job Fair; Mobilizes for "Immigration & African-American Communities" Forum
Pulic Good from Public Money
More than 300 Little Havana and Allapattah residents attended S. Florida JwJ's second annual Job Fair aimed at connecting community residents with employers receiving economic development money from the gorvernment. Special thanks to the building trades unions who offered great employment opportunities to Miami residents. Members of Vecinos Unidos [Neighbors United] spoke about accountable evelopment with County Mayor Carlos Alvarez, County Commission Chairman Joe Martinez and Miami Mayor Manny Diaz. Vecinos Unidos members also announced the campaign kick-off scheduled for Wednesday, August 16, 10:30 am at Henderson Park.
Building Immigrant Solidarity
The Coalition of Black Trade Unionists hosted the first-ever Town Hall Meeting on Immigration and African-American communities at Florida Memorial University. Nearly 200 attendees discussed building solidarity among working people in South Florida, especially African Americans and Black immigrants. Numerous community activists and elected officials weighed in on unfair immigration policies, cross culutral communication and the exploitation workers. Next will be a forum on Black and immigrant worker abuse after 9/11.
Vermont Nurses Win a Fair Contract!
Fletcher Allen Health Care and the Vermont Federation of Nurses and Health Professionals UPV/AFT Local 5221 reached agreement on a three-year contract in July. It is a victory for nurses, quality patient care and the community. The VT Workers' Center/JwJ helped organize over a thousand Vermonters to sign a support petition for the nurses, and to mobilize over two hundred people to participate in a rally and community vigil. Vermont Workers' Rights Board members wrote letters, called and met with the FAHC Administration to express their concern and share their support of the nurses' campaign.
Janitors' Victory on Long Island
Janitors at Mayco Building Services finally have won their more than year-long struggle for dignity and decent benefits. Three months after suddenly rejecting a tentative agreement, Mayco management finally agreed to an agreement that preserves workers' fully-funded health care. The Workers' Rights Board had recently sent Mayco a letter informing them that the WRB was looking into this case; the same day Mayco signed. "Jobs with Justice and the Workers' Rights Board were instrumental in this victory," said Shirley Aldebol, Campaign Coordinator for SEIU Local 32BJ on LI.
Indianapolis-Marion County Public Library Workers Win Resolution for Union Election
Indianapolis-Marion County Public Library workers won a victory on Thursday, August 17, in their efforts to win recognition for their union when the library board of trustees passed a unanimous resolution outlining a path to a union election for library employees.
Amid a full-to-capacity group of union supporters at their monthly meeting and after months of pressure from the workers' organizing campaign, including support from Central Indiana Jobs with Justice and many other concerned community groups and individuals, the library board stopped short of recognizing the union, but outlined a process that gives employees the right to have a seat at the bargaining table. More than 65 percent of employees have already signed union representation cards with AFSCME.
"This is a big victory for us and we're excited about the future," said Michael Torres, a library worker and union activist. "Our hard work, along with the help of so many library patrons who supported us, made this happen tonight. Now we move forward, take the next step in the process, and bring in a union.
Update: Immigrant Workers at Koch Foods in TN Win First Contract!
Through the spring and summer of 2005, immigrant workers employed at the Koch Foods chicken processing facility in rural Morristown, TN decided to take the brave step of speaking up about appalling working conditions and demanding that the company treat them with basic dignity and respect. To reach their goals, workers decided to organize with UFCW. Low-wage immigrant workers, often isolated by language barriers and laboring under the shadow of precarious immigration status, can find themselves all but invisible to members of the native-born community. In this campaign, workers broke out of that invisibility.
East Tennessee JwJ coordinated community support for the campaign, working with a diverse range of organizations, churches, and concerned individuals who played key roles including Centenary United Methodist Church, Church of the Savior United Church of Christ, East Tennessee Interfaith Worker Justice, the Equal Justice Center (of Austin, Texas) and its Poultry Worker Justice Project, the Highlander Research and Education Center, the Hispanic Ministry of the Roman Catholic Diocese of Knoxville, the Mississippi Poultry Workers Center, the Southern Empowerment Project, Southern Migrant Legal Services, Tennessee Valley Unitarian Universalist Church, UNITE HERE, United Campus Workers at UT, law students and graduate students from UT, and the United Food and Commercial Workers (including the international union as well as Locals 1995, 815-T and 272-T). Community members showed their solidarity at union meetings, wrote letters to Koch management, and gave the workers their moral support and their prayers. On July 24, hundreds of supporters converged in Morristown to hear from workers and organizers and to show their support. These varied efforts were sufficient to draw national attention, and the campaign was covered in a major article in the New York Times.
After this show of strength by the workers and their allies, Koch Foods announced that it would remain neutral towards the workers' choice to organize a union. On September 8 and 9, 2005, workers voted overwhelmingly (465 to 18) to join the UFCW! East Tennessee JwJ and other community allies are standing by the workers as they negotiate a contract to improve wages, benefits, and working conditions at the plant.
We are very happy to report that the workers at Koch Foods have now passed the additional important milestone of a first union contract. Along the way, the company made one "final offer" that union negotiators refused to endorse because it was so miserly on the pay and benefits. After the workers once again demonstrated their remarkable solidarity by rejecting the contract without a SINGLE vote in favor, the company returned to the bargaining table, and a contract has now been recommended, approved by the workers, and implemented on the job. A full-time service representative, Abel Margarito, has been hired to serve the Koch Food workers in Morristown. He attended the JwJ meeting in Knoxville on Thursday, June 1, and brought both the good news and the workers' thanks for JwJ's continued support.
Of course, many problems remain in the poultry industry and at the plant, but this is truly a welcome announcement and good news which we can all be proud of. JwJ of East Tennessee looks forward to working with workers at the Koch Food plant for many years to come.
